The outcome is not recorded unless an agreed settlement has been reached between the parties. That settlement should be recorded in writing and drawn up by either the parties or their respective legal representatives and signed by the parties and witnessed by their legal representatives. The Mediator should not play any part in the creation of the settlement agreement nor should the Mediator sign the document under any circumstances. The Mediator should not give any advice or recommendations on the terms of settlement. Once the document is signed by all parties except the Mediator it is legally binding.
